Abstract

In September 2020, the Massachusetts Supreme Judicial Court released three landmark rulings which, taken together, placed the judiciary front and center in the fight for racial justice. It was surprising then, to see the court’s recent ruling – Commonwealth v. Sweeting-Bailey – which effectively rolls back progress toward racial justice.
